近期泰辦處受理勞動契約認證，發現有部分案件，勞動契約文字不符規定，已陸續退回要求重新補正後再辦理。

泰辦處說明，爭議條文在第八條的「勞工保險及醫療給付」，依照勞工保險條例的規範，勞工在台死亡，喪葬費用由勞保支應，而非由雇主支付，但有部分契約，其英文內容則是由雇主負擔該筆費用。

該處人員表示，使用泰國官方版契約，對雇主較有利，提醒送件前應確認契約中、英文版內容，避免重新補件而延誤申請。

現行第八條「勞工保險及醫療給付」規範，雇主應為泰勞投保勞工保險及全民健保，其保險費及補償金應以中華民國勞工保險條例為準。

如泰勞死亡，雇主應負責處理喪事或運送屍體以及將泰勞個人物品送回泰國。

泰辦處表示，正確的英文翻譯，應為：＂During the employment, the Employee shall be protected under the Labor Insurance scheme with imposition of premiums and compensations of the R.O.C. Statue of Labor and Health Insurance. In the event of death of the Employee, the Employer shall be responsible to the funeral or transport to the domicile in Thailand the remains of the deceased as well as his personal belongings＂。
